Rental Conditions

General rental conditions for the rental of satellite communication equipment.

1. Rental price or purchase price:

The prices in the price list published at https://protegear.de at the time of rental apply.

2. Rental deposit:

The rental deposit is usually paid by providing a credit card. In the case of domestic public institutions, a rental deposit is not required upon request. The rental deposit can also be deposited on our account by bank transfer. When paying the deposit by credit card, we need the credit card details of the signing person from the customer. By signing the rental agreement, the customer agrees that the deposit amount will be secured on the credit card until the device returns to Global SafeTrack Systems and the invoice amount is then debited from the credit card. The deposit will be refunded by the landlord after the device has been returned and all outstanding invoices have been settled.

3. Payment:

The deposit is to be paid at the latest when the phone/accessories/system is handed over. Payment of the rental and connection fees must be completed after the device has been returned within 14 days of invoicing.

4. Cancellation:

If a rental contract is canceled later than 10 days before the start of the rental period, 20% of the rental fee to be calculated according to the contract can be charged as a cancellation fee. From 5 days before the start of the rental period, 50% of the rental fee to be calculated according to the contract will be charged as a cancellation fee.

5. Handover/Shipping:

Rented equipment will be shipped for domestic shipping and normal international shipping against calculation of the shipping flat rate. Express shipping possible on request.

6. Verification:

The renter or buyer is obliged to check the rented or purchased device for functionality immediately after taking it over. Any complaints should be sent to Global SafeTrack Systems within 2 days of delivery. Any damage complained about later may be at the expense of the tenant.

7. Fees:

When renting, the landlord pays the monthly basic fee for the provision of data service. Connection costs are not included in the rental price for telephone and accessories. In the case of rented satellite systems, the call minutes or call units used will be billed after the device has been returned. An itemized bill can be requested. The rental fees are calculated from the start date in the rental agreement until the actual return to the landlord. Any consequential costs charged to the landlord by third-party providers, which are caused by the tenant, for example when alerting an emergency service, or other costs for additional services triggered by the satellite telephone, shall be borne by the tenant.

8. Return:

Rented equipment must be returned in a timely manner in an insured package at the renter's expense. If the rented equipment is not returned as agreed and no mutual extension is agreed, the deposit can be confiscated from the end of the rental period and the SIM card and the telephone can be blocked by the satellite network operator.

9. Rental extension:

We strongly recommend specifying the return date in such a way that the actual latest date for redelivery to the landlord is specified in the rental agreement as the return date. All days of longer availability of the telephone and accessories for the renter will be charged according to the price list valid at the time of invoicing. This applies regardless of whether an extension was agreed or the delayed return was due to other reasons.

10. Default of payment:

If the tenant defaults on the payment/final payment, the default interest is 3% above the federal discount rate, but at least 6% annually.

11. Usability:

We make no formal promise that the satellite device may be carried into and/or operated in, or technically capable of being operated in, the renter's or purchaser's destination country. In addition, registration with local authorities or with the network operator may be necessary in order to be able to use the device without restrictions. 12. Disclosure:

The lessee may only pass the device on to third parties for use with our written consent.

13. Consequential damage:

We accept no liability for consequential damage if the satellite phone or its accessories are or become non-functional and/or unavailable for use during the rental period.

14. Availability:

The lessor does not guarantee that the rented equipment will be available at the start of the contract if the reason for the non-availability is beyond his control or is due to force majeure. However, he will endeavor to procure replacement devices in good time with the diligence of a prudent businessman.
15. Agreements:

Oral subsidiary agreements require written confirmation.

16. Liability:

The lessor's liability is limited to intent and gross negligence.

17. Damage:

Devices and equipment that arrive damaged when they are returned will be repaired or replaced at the expense of the lessee and, if necessary, the rental period of the loss of use will be charged.

18. Theft/Loss:

Theft, loss, destruction or confiscation must be reported as soon as possible. The renter is obliged to pay for the rented equipment, accessories and the preloaded credit.

20. Jurisdiction:

For all disputes arising from or about this contract, Rosenheim is agreed as the place of jurisdiction and place of performance.

21. Invalidity:

Should individual conditions be invalid, the remaining conditions remain unaffected.

22. Final provision:

The law of the Federal Republic of Germany.
